Chewton Street, Eastwood

Peacock + Smith acted as planning agent for Gleeson Homes for an appeal (by hearing) following the refusal of a full application by Broxtowe Borough Council for the development of 251 dwellings on land at Chewton Street, Eastwood.  The appeal was allowed by the Planning Inspectorate on 24 April 2024, including a partial costs award.

The application had been recommended for approval by the Case Officer, but it was refused by the Council’s Planning Committee. The key issue to be considered at appeal was the potential risk to human health arising from potential landfill gas from a former tip adjacent to the application site.  Taking into account proposed mitigation measures, the appeal Inspector found that this risk was not unacceptable, whereas the Council had advanced a no-risk planning argument.  The appeal decision also concludes that the proposals would constitute sustainable development, and there is an unmet need for additional housing when compared to Core Strategy housing requirements.
